On Sunday, October 23rd, in DeKalf County, a female pedestrian was struck and killed by a Jeep Cherokee on Moreland Avenue and Constitution Drive. As experienced Atlanta pedestrian accident attorneys, we realize that many of these types of accidents are “hit and run” accidents in which the driver of the vehicle leaves the scene of the crime. In this case, the driver remained at the scene until police arrived; his name has not been released, and charges are pending.
The area where the accident took place is known for heavy foot traffic and has been in Atlanta news headlines recently. In this accident, 40-year-old Michelle Turner of Clarkston was attempting to cross the street when she was struck by the SUV. According to DeKalb police, the accident occurred around 10 p.m. as Turner tried to cross Moreland Avenue. It is unclear whether she was in the crosswalk at the time she was crossing the street.
In most states, pedestrians are required to cross at traffic signals or crosswalks only; other states (like Georgia) allow pedestrians to cross certain streets outside of a crosswalk, but the pedestrian must yield right of way to any vehicle.
