DeKalb County Pedestrian Struck and Killed by Motorist

On Sun­day, Octo­ber 23rd, in DeKalf County, a female pedes­trian was struck and killed by a Jeep Chero­kee on More­land Avenue and Con­sti­tu­tion Drive.  As expe­ri­enced Atlanta pedes­trian acci­dent attor­neys, we real­ize that many of these types of acci­dents are “hit and run” acci­dents in which the dri­ver of the vehi­cle leaves the scene of the crime.  In this case, the dri­ver remained at the scene until police arrived; his name has not been released, and charges are pending.

The area where the acci­dent took place is known for heavy foot traf­fic and has been in Atlanta news head­lines recently.  In this acci­dent, 40-year-old Michelle Turner of Clark­ston was attempt­ing to cross the street when she was struck by the SUV.  Accord­ing to DeKalb police, the acci­dent occurred around 10 p.m. as Turner tried to cross More­land Avenue.  It is unclear whether she was in the cross­walk at the time she was cross­ing the street.

In most states, pedes­tri­ans are required to cross at traf­fic sig­nals or cross­walks only; other states (like Geor­gia) allow pedes­tri­ans to cross cer­tain streets out­side of a cross­walk, but the pedes­trian must yield right of way to any vehicle.
